<\/strong>Auto Auktion Swiss<\/strong><\/h1>\n\n\n\n

1. General provisions<\/strong><\/h2>\n\n\n\n

  1. The owner and operator of the Internet service available at autoauktionswiss.com<\/a> is uniAuto AG<\/strong>, headquartered at Mezikonerstrasse 15, 9532 M\u00fcnchwilen, Switzerland, hereinafter referred to as “Operator”.<\/li>\n\n\n\n
  2. Use of the Website is possible only after registration of a user account and acceptance of these Terms of Use and Privacy Policy.<\/li>\n\n\n\n
  3. The User of the Website may be a natural person with full legal capacity or a legal person, hereinafter referred to as the “Buyer”.<\/li>\n<\/ol>\n\n\n\n

    2 Security deposit (bid bond)<\/strong><\/h2>\n\n\n\n
      \n
    1. As a condition for being able to submit bids on the Service, a refundable security deposit (deposit) of CHF 1,000 must be paid.<\/li>\n\n\n\n
    2. The deposit is in the nature of a security for the proper performance of the Buyer’s obligations arising from participation in the auctions.<\/li>\n\n\n\n
    3. The deposit is interest-free and does not constitute a down payment for the purchase of the vehicle.<\/li>\n\n\n\n
    4. In the absence of obligations to the Operator, the deposit is refundable after the closure of the user account or at the individual request of the Buyer, as long as he does not participate in active auctions.<\/li>\n\n\n\n
    5. The operator provides separate bank accounts:\n
        \n
      • For deposit payments,<\/li>\n\n\n\n
      • For settlement of purchased vehicles and other Items.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n

        3 The nature of the service<\/strong><\/h2>\n\n\n\n
          \n
        1. The service serves as an intermediary platform that allows bids for the purchase of vehicles and other items from, among other things, auctions held by insurance companies. <\/li>\n\n\n\n
        2. The information presented on the Website is for reference and information purposes only and does not constitute a commercial offer within the meaning of the applicable laws.<\/li>\n\n\n\n
        3. The operator is not the owner of the offered vehicles, unless expressly indicated otherwise.<\/li>\n\n\n\n
        4. The operator is not responsible for:\n
            \n
          • The technical condition of the vehicles,<\/li>\n\n\n\n
          • completeness of equipment,<\/li>\n\n\n\n
          • Compliance of descriptions with the facts,<\/li>\n\n\n\n
          • errors or inaccuracies in the documentation and descriptions provided by insurers or auctioneers.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
          • The buyer makes the decision to bid at his own risk.<\/li>\n<\/ol>\n\n\n\n

            4 Rules for submitting bids<\/strong><\/h2>\n\n\n\n
              \n
            1. Each item available on the Website has an individual reference number.<\/li>\n\n\n\n
            2. Buyer points out:\n
                \n
              • selected subject,<\/li>\n\n\n\n
              • maximum bid amount,<\/li>\n\n\n\n
              • consent to the Operator’s participation in the auction on its behalf.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
              • The operator shall forward the Buyer’s bid to the relevant external auction.<\/li>\n\n\n\n
              • The bid submitted is binding and cannot be withdrawn once it has been submitted for auction.<\/li>\n\n\n\n
              • The buyer acknowledges that the auctioneer may:\n
                  \n
                • extend the auction,<\/li>\n\n\n\n
                • re-bid,<\/li>\n\n\n\n
                • leave previously submitted bids active.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n

                  5 Auction result and payment<\/strong><\/h2>\n\n\n\n
                    \n
                  1. Information on the outcome of the auction is communicated to the Buyer immediately after the end of the auction.<\/li>\n\n\n\n
                  2. Final confirmation of the award of the vehicle by the auctioneer may take place within 30 working days after the end of the auction.<\/li>\n\n\n\n
                  3. Once the sale is approved, the Operator sends the Buyer the payment details for the purchased item.<\/li>\n\n\n\n
                  4. The buyer is required to make full payment within 3 business days of receiving confirmation of the award of the vehicle or other item.<\/li>\n<\/ol>\n\n\n\n

                    6 Penalties and consequences of non-payment<\/strong><\/h2>\n\n\n\n
                      \n
                    1. In the event of late payment, additional costs for parking or storage of the vehicle may be charged in the amount of CHF 30 for each started day of delay.<\/li>\n\n\n\n
                    2. In the event of refusal to pay for the auctioned vehicle, the buyer agrees to pay a contractual penalty of 20% of the amount offered, but not less than CHF 3,000.<\/li>\n\n\n\n
                    3. The operator has the right:\n
                        \n
                      • retain the deposit paid,<\/li>\n\n\n\n
                      • block the user’s account,<\/li>\n\n\n\n
                      • deny further access to the Service.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n

                        7. vehicle release<\/strong><\/h2>\n\n\n\n
                          \n
                        1. Release of the vehicle or other object shall be made after:\n
                            \n
                          • Payment of all dues,<\/li>\n\n\n\n
                          • posting of payment,<\/li>\n\n\n\n
                          • completion of the auctioneer’s procedures.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
                          • Acceptance can take place:\n
                              \n
                            • At the address indicated,<\/li>\n\n\n\n
                            • At the place designated by the Operator,<\/li>\n\n\n\n
                            • via transportation organized by the Operator.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
                            • Ownership of the vehicle passes to the Buyer after full settlement of all amounts due to the Operator.<\/li>\n<\/ol>\n\n\n\n

                              8 Liability relating to vehicles<\/strong><\/h2>\n\n\n\n
                                \n
                              1. The auctioneer or insurer may release the vehicle in a condition that differs from that shown in the photos or description.<\/li>\n\n\n\n
                              2. Accessory equipment including, but not limited to:\n
                                  \n
                                • handles,<\/li>\n\n\n\n
                                • child seats,<\/li>\n\n\n\n
                                • rugs,<\/li>\n\n\n\n
                                • repair kits,<\/li>\n\n\n\n
                                • roof racks,
                                  may not be part of the sale.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
                                • The auctioneer may:\n
                                    \n
                                  • Remove damaged vehicle components,<\/li>\n\n\n\n
                                  • Issue the vehicle with one set of keys,<\/li>\n\n\n\n
                                  • restore the vehicle to factory condition after the owner’s previous modifications.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n

                                    9 Complaints and disputes<\/strong><\/h2>\n\n\n\n
                                      \n
                                    1. The parties undertake, in the first instance, to resolve amicably any disputes arising from the use of the Service.<\/li>\n\n\n\n
                                    2. In case of disagreement, disputes will be settled by the court having jurisdiction over the Operator’s headquarters.<\/li>\n<\/ol>\n\n\n\n

                                      10. final provisions<\/strong><\/h2>\n\n\n\n
                                        \n
                                      1. Registration of an account on the Website implies acceptance of these terms and conditions.<\/li>\n\n\n\n
                                      2. The Operator reserves the right to make changes to the Terms of Service. The changes are effective from the moment they are published on the Website. <\/li>\n\n\n\n
                                      3. The current version of the terms and conditions is available on the Website at all times.<\/li>\n<\/ol>\n\n\n\n
